This Privacy Policy explains what information we collect through the website located at karamirakfitness.com (the "Site") and in the course of providing our personal training, coaching, programs, and challenges (the "Services"), how we use it, and the choices you have.

 

By using the Site or the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Site or the Services.

 

The short version: We collect only the information we need to train you, run our programs, communicate with you, and operate the Site. We do not sell your personal information, and we do not share it for advertising. We share information only with the service providers that help us run the business, and only as described below.

 

1. Information We Collect

Information you provide to us. We collect information you give us directly, including when you fill out a contact or sign-up form, book a session, subscribe to our newsletter, purchase a program, or communicate with us. This may include:

• Contact details — your name, email address, and phone number;

• Fitness and health information — your fitness goals and any health history, injuries, conditions, limitations, or similar information you choose to share so we can train you safely and effectively;

• Booking and account information — sessions scheduled, programs or challenges you join, and related preferences;

• Payment information — when you pay online, payment is processed by our third-party payment processor; we receive limited transaction details (such as confirmation and the last digits of a card), and we do not store full payment card numbers ourselves. When you pay offline (cash, check, or a peer-to-peer app), we collect only what is needed to record the transaction;

• Communications — the contents of emails, texts, and form messages you send us.

 

Information collected automatically. When you visit the Site, certain information is collected automatically through cookies and similar technologies, including your IP address, browser and device type, pages viewed, and general usage data. Our website host, Wix, collects and processes some of this information to operate, secure, and analyze the Site. See Section 4.

 

2. How We Use Your Information

• Provide, schedule, and deliver the Services and respond to your inquiries;

• Train you safely, including reviewing the health and fitness information you provide;

3. Sensitive Health and Fitness Information

The health and fitness information you share with us is sensitive, and we treat it that way. We collect it only to provide the Services safely and use it only for that purpose and the related purposes described in this Policy. Please note that as a personal trainer, Kara Mirak Fitness is not a "covered entity" under HIPAA, so HIPAA does not apply to this information; nonetheless, we limit our use and disclosure of it as described here, and we ask that you share only what is relevant to your training.

 

4. Cookies and Tracking Technologies

The Site uses cookies and similar technologies. Our website platform, Wix, uses essential cookies to operate and secure the Site and analytics cookies to understand how visitors use it. These help the Site function, remember your preferences, and improve performance.

We take reasonable administrative, technical, and physical measures to protect your information, and we rely on the security protections of our service providers, including Wix and our payment processor. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

• Email marketing. You can unsubscribe from marketing emails at any time using the unsubscribe link in any such email. We may still send you non-promotional messages about your sessions or account.

• Text messages. If you receive marketing texts from us, you can opt out by replying STOP. Standard message and data rates may apply.

• Cookies. You can manage cookies through your browser settings as described in Section 4.

• Access and updates. You may contact us at any time to review or update the information you have given us.

 

9. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the "CCPA"), gives you certain rights regarding your personal information.

In the past 12 months, we may have collected the following categories: identifiers (such as name, email, phone, and IP address); customer records (such as contact and payment information); commercial information (such as programs or sessions purchased); internet or network activity (such as Site usage); approximate geolocation (derived from IP address); and sensitive personal information in the form of the health and fitness information you choose to provide. We collect this information for the business purposes described in Section 2.

We do not sell or share your personal information as those terms are defined under the CCPA, and we have not done so in the preceding 12 months. We use and disclose sensitive personal information only for the purposes permitted under the CCPA, such as providing the Services you request.

 

Your rights. Subject to certain exceptions, California residents have the right to:

• Know/Access the categories and specific pieces of personal information we have collected about you;

• Delete personal information we have collected from you;

• Correct inaccurate personal information;

• Opt out of the sale or sharing of personal information (note: we do not sell or share, so there is nothing to opt out of);

• Limit the use of sensitive personal information (note: we already limit our use as described above); and

• Non-discrimination — we will not discriminate against you for exercising any of these rights.

 

How to exercise your rights. Submit a request using the contact details in Section 12. We will verify your request by confirming information we already have on file, and we will respond as required by law. You may use an authorized agent to submit a request on your behalf, subject to verification.

 

10. Children's Privacy

The Site and Services are intended for adults 18 and older and are not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.
 

11. Third-Party Links

The Site may link to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies.
